As the estate agent has a good knowledge of the local market, he is the right person to talk to for someone who wants to buy a flat. He is informed on the every day updates of the local market transaction and of the criteria that influence the value of the real estate which makes him a privileged adviser.


Housing profits

The article 10 of the finance law of 2004 reforms the taxes system of the housing profits done by private individuals, when they sale buildings or company property shares. The reform consists in relieving the taxpayers of any registration, by substituting a proportional rate of 16% and the social taxes to the current tax regime.
The notary is now in charge of the setting up of the registration, and of the tax payment for the buyer.

The preliminary sale agreement

Buyer or seller often think that the signing of a pre-contract –like the preliminary sale agreement- is not very important. This is incorrect: the sale compromise is indeed a contract which lead to important legal obligations on both parts.
The necessity of a pre-contract is:

The deadline for obtaining an updated urbanism certificate, without which the selling is impossible
The uncertainty for the buyer to be able to obtain the financing

These 2 points are the canceling conditions of the pre-contract

According to the French SRU law (law issued in 13th December 2000 about the solidarity et the urban renewal), a retract right of 7 days exists for every time of accommodations: new or old.
